New South Wales Mandates 40% Wind Energy for New Data Centers Under Landmark Framework

The Australian state of New South Wales (NSW) has unveiled a sweeping new policy requiring all newly built data centers to source at least 40 percent of their electricity from wind energy, a move that positions the state as a global frontrunner in tying digital infrastructure growth to renewable energy expansion. The framework, announced by the state government, is designed to ensure that the rapid proliferation of data centers does not outpace the development of clean energy and water infrastructure.

Under the new rules, data center developers must demonstrate that they have entered into Power Purchase Agreements (PPAs) with renewable energy providers. In addition to the wind energy mandate, developers will be required to comply with stringent environmental and efficiency standards, ensure no net cost is imposed on consumers, and fund additional supplies of water and energy. The state has promised an expedited approval pathway for compliant projects, with a commitment to assess applications within 75 days—a significant acceleration compared to typical review timelines.

NSW Treasurer Daniel Mookhey said the policy had been in development for more than a year and emphasized that developers would bear the financial responsibility for the new clean energy requirements. "We are launching a nation-leading policy to make sure that rising data center investment is matched with increased investment in renewable energy and water infrastructure," Mookhey said. He warned that non-compliant projects face rejection, stating, "Those data center builders that choose not to comply with these guidelines will have to take the risk that their projects are going to get refused." He added, "We're pretty clear that these are our expectations … any data center builder that chooses not to comply with these standards will find themselves almost alone."

The framework also includes a water pricing review to be conducted by the Independent Pricing and Regulatory Tribunal (IPART). The review aims to "ensure water users on the network are protected, and the impacts of drought and water scarcity are appropriately managed." Separately, the NSW government will establish a new 'Office of AI' to coordinate government investment in digital and AI assets, ensuring that "AI supports workers, strengthens capacity and is implemented responsibly across the public sector."

The policy arrives at a critical juncture for the state's digital economy. According to the NSW government, 90 data center facilities are currently operating in the state, most clustered around the Sydney metropolitan area. Major operators in the region include AirTrunk, AWS, Equinix, and NextDC. As demand for cloud services and AI workloads continues to surge, the state is seeking to balance economic growth with environmental sustainability.

Industry analysts view the NSW framework as a potential template for other jurisdictions grappling with the energy-intensive nature of modern data centers. By linking project approval to renewable energy procurement, the state is effectively shifting the burden of grid decarbonization onto the private sector. While the 40 percent wind energy requirement is ambitious, it reflects a broader trend among governments worldwide to align digital infrastructure with climate goals. The success of this policy could influence how other Australian states and international markets regulate data center development in the years ahead.
