Bimergen Energy Corporation (NYSE American: BESS), a Newport Beach-based developer, owner, and operator of utility-scale and distributed battery energy storage systems, announced that its wholly owned subsidiary, Emergen Commodities LLC, has filed an application with the Public Utility Commission of Texas (PUCT) for an Option 2 Retail Electric Provider (REP) certificate. The filing, submitted on October 5, 2026, under Docket No. 60368, marks a strategic step toward adding retail electricity supply capabilities to the company's energy infrastructure business and positioning it to serve the state's rapidly expanding data center market.
The move comes as Texas cements its status as the nation's leading data center hub, with a development pipeline valued at approximately $200 billion. Large-scale data centers require substantial and continuous electricity supply, creating a significant commercial opportunity for certified retail providers capable of delivering reliable power at scale. Subject to regulatory approval and applicable market requirements, the certification would enable Emergen Commodities to supply electricity directly to qualifying data center customers in Texas, establishing a foundation for recurring revenue streams through long-term customer supply agreements.
Texas' Option 2 certification provides a pathway to serve specifically identified customers contracting for at least one megawatt of capacity. Cole Johnson, Co-CEO of Bimergen Energy, described the initiative as a step toward broadening the company's capabilities in the Texas energy market, noting that the substantial electricity requirements of large data centers present a compelling commercial opportunity. He added that by building on the company's energy infrastructure expertise and adding retail electricity supply capabilities, Bimergen believes it can position itself to participate in this growing market and create additional opportunities for long-term value.
In parallel with the regulatory process, Bimergen is working with multiple counterparties to provide credit support for large data center loads, an effort intended to underpin the electricity supply arrangements needed to serve customers with substantial power requirements. Bob Brilon, Co-CEO of Bimergen Energy, said the company is focused on translating this opportunity into a commercially viable business that can contribute meaningfully to long-term growth, and that the work to establish necessary credit support and advance the regulatory process reflects a disciplined approach to entering the market.
The proposed retail electricity capability would complement Bimergen's broader strategy of advancing battery energy storage projects through development, technology partnerships, and collaboration with capital providers. By expanding the ways the company participates in the energy market and connecting its infrastructure expertise with electricity needs, the initiative represents a natural extension of its core business. The application is currently under regulatory review and remains subject to PUCT approval.
