China: "Personal Information Protection Law" Effective from November 1,2021

The 30th meeting of the Standing Committee of the 13th National People's Congress voted and passed the "Personal Information Protection Law of the People's Republic of China" on the 20th. The Personal Information Protection Law will come into effect on November 1, 2021.

 

"Personal Information Protection Law"

 

The "Personal Information Protection Law of the People's Republic of China" clearly states:

 

Information push and commercial marketing to individuals through automated decision-making methods should provide options that are not specific to their personal characteristics or provide convenient ways to refuse.

 

The processing of sensitive personal information such as biometrics, medical and health, financial accounts, whereabouts, etc. requires individual consent.

 

For applications that illegally process personal information, they shall be ordered to suspend or terminate the provision of services.
