Recently, the Ministry of Industry and Information Technology (hereinafter as MIIT) released <the Notification on Cleaning up to Regulate the Internet Network Access Service Market by MIIT>(hereinafter as the Notification), the Notification decided that, Since now, the cleaning up and regulation work on internet access service market will be carried out all over the country till March 31 2019.
In accordance with laws and related regulations, MIIT will investigate and raid action towards violating and illegal activities existing in business markets of IDC, ISP and CDN services, including unlicensed business activities, operations beyond licensed business scope, “layes of sublet”and so on, truly put the corporate entity responsibility into practice, enhance management on operation licensing access resources, intensify internet information security management, maintain fair and well-organized market order, boost industrial health development.
The Notification requests that, local communication regulatory authorities should practice investigation and survey for enterprises providing IDC, ISP, CDN services under their jurisdiction areas, completely eradicate illegal business activities including unlicensed operation, unlicensed operation beyond regulated area or business scope, sublease or transfer possessions of license, etc. Each fundamental communication enterprise, internet access service provider should carry out overall self-inspection, without telecom regulatory body’s approval, no enterprise can establish or rent specific line and wire (in VPN) to implement cross-border operations.
Each internet access service providers should furthur reinforce legal awareness, completely and deeply carry out self-inspection, examine operations upon criterion, practically achieve law-abiding operation under compliance. They should also self-conscisously terminate corporation with illegal enterprises, ensure sources, distribution and usage of communication network resource legal.
Meanwhile, each communication regulatory authority should act upon principle of “dependency responsible, passing one by one”, enhance cross-regional collaboration, examine and verify violating clues one by one, handle relative enterprise upon sorting treatment, adopt targeted measurements, supervise and enhance enterprise’s law-abiding operations under compliance. For those enterprises refuse to rectify, investigation and raid action would be implemented as per laws and regulations, and applied with credit management mechanism followed by pushiment as warning.
Each fundamental telecom enterprise should enhance management of network resources and user standing book, adopt technical, managing and legal measurements, prevent network resources from illegal operation. They should also coorporate with communication regulatory authorities to carry out violating clues examination and verification well, close up and terminate network resources used in illegal operations and usage. They should abide the requirement of “network speed up, charging down”, ensure different network resources demand from various enterprises and users, provide steady and firm foundation for network access service provider’s law-abiding operation under compliance and continual, healthy development of the whole market.
